When you complete and submit the Form, you are requesting that we:
- Review your information (name, contact details, area of interest, price range, and home preferences), and
- Reach out to you within a reasonable time frame (typically within 24 hours) with homes that match your needs, and
- Communicate with you by phone, email, and/or text message regarding your real estate inquiry.
Submitting the Form does not create any obligation for you to buy or sell a home, nor does it by itself create an agency or client relationship. Any formal representation or agency relationship will be established separately, typically through a written agreement.
By submitting the Form, you represent and warrant that:
- All information you provide is true, accurate, and complete to the best of your knowledge.
- You are providing your own contact information (and not someone else’s without their permission).
- You are at least 18 years of age or legally able to enter into these Terms.
You understand that providing incomplete or inaccurate information may limit our ability to send you relevant home matches or respond to your inquiry.
We use the information you provide through the Form to:
- Contact you regarding your real estate inquiry.
- Provide you with homes and properties that may match your areas of interest and price range.
- Schedule or confirm calls, showings, or consultations.
- Send updates, reminders, and follow-up communications related to your inquiry.
- Send marketing and promotional messages if you separately consent to receive them (see Sections 6 and 7).
Our collection and use of your information are further described in our Privacy Policy, which forms part of these Terms.
By submitting the Form, you agree that we may contact you using the contact information you provided (phone number and email address), including via:
- Phone calls
- SMS/text messages
- Emails
for purposes reasonably related to your inquiry and our real estate services, such as:
- Responding to your questions
- Sending homes that may match your criteria
- Scheduling and confirming appointments or showings
- Providing important updates related to your request or an ongoing transaction
Message frequency may vary depending on your level of engagement and current activity. Message and data rates may apply, depending on your mobile carrier and plan.
The first checkbox on the Form relates to non-marketing (transactional) text messages. The text associated with that checkbox states:
“By checking this box, I consent to receive non-marketing text messages from McLarry Property Group about East Texas Home Search. Message frequency varies, message & data rates may apply. Text HELP for assistance, reply STOP to opt out.”
By checking this first box, you explicitly consent to receive non-marketing, service-related SMS/text messages from McLarry Property Group at the phone number you provide on the Form for these purposes.
You can opt out at any time by replying STOP to any message we send. Reply HELP for assistance.
The second checkbox on the Form relates to marketing and promotional communications. The text associated with that checkbox states:
“By checking this box, I consent to receive marketing and promotional messages including special offers, discounts, new product updates among others from McLarry Property Group at the phone number provided. Frequency may vary. Message & data rates may apply. Text HELP for assistance, reply STOP to opt out.”
By checking this second box, you explicitly consent to receive marketing and promotional messages from McLarry Property Group at the phone number you provide, which may include:
- New listing alerts and market updates
- Educational content about buying, selling, or investing in real estate
- Special offers, events, or other promotions related to our services
- Message frequency may vary. Message and data rates may apply.
You can opt out of marketing texts at any time by replying STOP to any message we send. Reply HELP for assistance.
Your consent to receive:
- Non-marketing (transactional) text messages (first box), and/or
- Marketing and promotional messages (second box)
is not a condition of purchasing any property, using our real estate services, or entering into any transaction with McLarry Property Group. You may still work with us even if you choose not to receive marketing messages.
However, if you opt out of all communications (including transactional messages), we may be limited in our ability to respond to your inquiry or provide you with property matches.
You may opt out or change your communication preferences at any time:
- SMS/Text Messages: Reply STOP to unsubscribe from future texts from the sending number. Reply HELP for help.
- Marketing Emails: Use the unsubscribe link included in any marketing email we send.
- Phone Calls: Let us know during a call, or contact us via email and request removal from future call lists.
Please note that opting out of marketing messages may not stop all transactional or service-related communications when they are needed to respond to or complete an active request or transaction (for example, appointment confirmations).
Wireless carriers are not liable for delayed or undelivered messages. We are not responsible for:
- Any delays in message delivery, and/or
- Messages that are blocked or filtered by your carrier or device settings.
You are responsible for ensuring that your mobile number is current and capable of receiving SMS/text messages.
The property information, recommendations, and general guidance we provide through our communications are for informational purposes only. We do not guarantee:
- The availability of any specific property
- That any specific property will meet your needs or preferences
- That any offer will be accepted or any transaction will close
You are encouraged to conduct your own due diligence and to consult with appropriate professionals (such as inspectors, appraisers, lenders, attorneys, and tax advisors) before making any real estate decisions.
To the fullest extent permitted by law, McLarry Property Group and its owners, agents, employees, and affiliates will not be liable for any:
- Indirect, incidental, consequential, special, or punitive damages, or
- Loss of profits, revenue, data, or business opportunities
arising out of or relating to:
- Your use or attempted use of the Form, or
- Your receipt or non-receipt of any messages, calls, or emails, or
- Any reliance on information provided through such communications.
Your sole remedy for dissatisfaction with the Form or related communications is to stop using the Form and/or opt out of further communications as described in these Terms.
We may update, modify, or discontinue the Form or these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this document.
Your continued use of the Form after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Form and refrain from submitting your information.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
Any disputes arising from or related to these Terms or your use of the Form shall be resolved in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.
